Terms of Service

1. Introduction & Acceptance

MIX+ ("Company," "we," "us," "our") operates a digital streaming platform accessible via website, mobile applications, Fire TV, and other platforms (the "Service"). These Terms of Service ("Terms") constitute a legally binding agreement between you and MIX+ regarding your use of the Service.

By accessing, registering for, or using MIX+, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Changes become effective when posted on this page with an updated "Last Updated" date. Continued use of the Service following such changes constitutes your acceptance of the revised Terms.

2. Eligibility & Account Registration

2.1 Age Requirements

MIX+ is not intended for children under the age of 13. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and enter into this binding agreement. If you are between 13 and 18, you may use MIX+ only under the direct supervision and consent of a parent or legal guardian who accepts these Terms on your behalf.

2.2 Account Creation

To access the Service, you must create an account by providing:

• A valid email address
• A password (which you must keep confidential)
• Accurate profile information

2.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration. MIX+ reserves the right to suspend or terminate your account if we believe information is inaccurate, false, or fraudulent.

3. Use License & Restrictions

3.1 Limited License

MIX+ grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial streaming purposes only. This license does not include the right to:

• Download, reproduce, or distribute content
• Circumvent or disable access controls or DRM
• Use automated tools or bots to access the Service
• Reverse engineer or decompile code
• Create derivative works from content
• Sublicense, resell, or share your account with others

3.2 Prohibited Uses

You agree not to:

• Use the Service for illegal purposes
• Engage in harassment or hate speech
• Upload malware or malicious code
• Attempt unauthorized access to accounts or systems
• Interfere with platform operation or security
• Violate intellectual property rights
• Stream content to public venues without proper licensing

3.3 Geo-Restrictions

MIX+ content is licensed for use primarily in Haiti and by the Haitian diaspora. We may restrict access based on geographic location. Attempting to circumvent geo-blocking measures (VPNs, proxies, etc.) violates these Terms and may result in account suspension.

4. Subscriptions & Billing

4.1 Subscription Plans

MIX+ offers multiple subscription tiers including Free Plan (limited access), Paid Subscription (full access), and Rental (24-72 hour windows). Features, pricing, and duration are displayed at purchase time.

4.2 Pricing & Payment

Prices are in USD unless otherwise stated. Billing occurs automatically on renewal dates. Payment is processed through third-party providers (Stripe, Braintree, PayPal). We do not store complete credit card numbers; only the last 4 digits are retained.

4.3 Refunds & Cancellations

Subscriptions: No refunds for partial months. Cancellations must be submitted before renewal date to avoid charges.
Rentals: Non-refundable once playback begins. Technical failures eligible for refund within 24 hours.
Billing Disputes: Contact us at billing@mixplus.tv within 30 days of charge.

4.4 Automatic Renewal

Subscriptions automatically renew at each billing period. Cancel anytime through account settings or by contacting support before renewal date.

5. Device Management & Simultaneous Streams

5.1 Device Registration

All users must register devices upon first login. Device information is collected for security and licensing compliance.

5.2 Device Limits

Free Plan: 1 active device
Paid Subscription: Up to 2-3 devices per plan (depending on tier)

When device limit is reached, remove an old device before streaming on a new one. Manage devices at mixplus.tv/user/devices.

5.3 Simultaneous Streaming

Simultaneous streams are limited based on your plan. Exceeding this limit will interrupt playback on additional devices.

6. Content & Licensing

6.1 Ownership

All content is owned or licensed by MIX+. Your subscription grants a limited right to stream for personal use only. You do not own the content.

6.2 Personal Use Only

Streaming is for personal, non-commercial viewing. Public display without proper licensing is prohibited. Downloading, recording, and account sharing are prohibited.

6.3 Rental Terms

Rental periods are 24-72 hours from playback start. No extensions or refunds once playback begins. Failed rentals eligible for refund if reported within 24 hours.

6.4 Live TV Access Tiers

Preview: Free for all registered users
Free: Login required
Premium: Paid subscription or category subscription required

7. Intellectual Property Rights

MIX+ uses industry-standard DRM and encryption to protect content. Circumventing DRM protections is prohibited. If you believe content infringes your rights, contact copyright@mixplus.tv.

8. Limitation of Liability & Disclaimers

8.1 "As-Is" Disclaimer

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES. MIX+ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

8.2 No Guarantee of Availability

MIX+ does not guarantee continuous, uninterrupted, or error-free operation. Outages, maintenance, and content removal may occur without notice.

8.3 Limitation of Damages

MIX+'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS, OR $100 USD, WHICHEVER IS GREATER.

9. Termination & Suspension

9.1 Termination for Cause

MIX+ may suspend or terminate accounts for:

• Violation of these Terms or applicable laws
• Fraud or unauthorized access attempts
• Abuse of the Service or other users
• IP violations or security risks
• Excessive chargebacks or payment failures
• VPN/proxy use to circumvent restrictions
• Account sharing for payment avoidance

10. Dispute Resolution & Governing Law

10.1 Governing Law

These Terms are governed by the laws of Haiti, without regard to conflict of law principles.

10.2 Jurisdiction

Disputes shall be resolved in the courts of Port-au-Prince, Haiti.

10.3 Informal Resolution

Before legal proceedings, contact support@mixplus.tv to resolve disputes informally within 30 days.
